DriveU Travel-Intermediary User Terms & Conditions (Chauffeur-Driven Car Rental Services)

These DriveU terms and conditions ("Customer Terms") shall operate as a binding agreement between you and DriveU that will govern your use of our Site, Services, documents, material and intellectual property (hereinafter collectively referred to as "Offerings") which are owned, controlled and this document is an electronic record in terms of Information Technology Act, 2000 and rules thereunder as applicable and the provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. By accessing or using any or all of the Offerings, or by clicking on the 'I Accept' button on the Application, you signify that you have read, understood and agree to be bound by these Customer Terms. If you do not agree with any part or all of these Customer Terms, please do not access or use the Offerings, or do not click on the 'I Accept' button on the Application. For the purposes of these Terms of Use, "we", "our" and "us" shall mean the DriveU and "you" and "your", shall mean a user of the Offerings ("Customer"). Your acceptance of the Customer Terms shall be deemed to include your acceptance of the privacy policy available at https://www.driveu.in/privacy-policy

1. DEFINITIONS

  • a."DriveU" means DriveU Mobility Solutions Private Limited.
  • b."Platform" means the DriveU website, mobile application, and related systems.
  • c."Operator" means an independent third-party cab rental or tour operator offering transportation services.
  • d."Service" means cab rental or transportation services provided by Operators to Users.
  • e."Booking" means a confirmed reservation for Services facilitated through the Platform.
  • f."Fare" means the amount payable for Services, determined by the Operator.
  • g."Applicable Law" means all laws, rules, and regulations in force in India.

2. SCOPE OF DRIVEU'S ROLE

  • a.DriveU operates solely as a technology platform and travel intermediary facilitating bookings between Users and independent Operators.
  • b.DriveU does not provide transportation services, does not own vehicles, and does not employ drivers.
  • c.The contract for transportation services is strictly between the User and the Operator.
  • d.DriveU does not act as:
    • a.A carrier
    • b.A transport service provider
    • c.A motor vehicle aggregator

3. NATURE OF SERVICES

  • a.All transportation services are:
    • a.Provided exclusively by Operators
    • b.Subject to the Operator's permits, licences, and regulatory compliance
  • b.DriveU does not:
    • a.Assign or dispatch drivers
    • b.Control routes or trip execution
    • c.Supervise driver conduct during trips

4. BOOKING & CONFIRMATION

  • a.Bookings are advance, scheduled car rentals only.
  • b.Upon booking:
    • a.DriveU transmits the booking request to the Operator
    • b.The Operator confirms availability and acceptance
  • c.Booking confirmation constitutes:
    • a.An agreement between the User and the Operator
    • b.Acceptance of the Operator's service terms

5. PRICING & PAYMENT

  • a.Fares displayed on the Platform are provided by Operators.
  • b.DriveU may collect payment:
    • a.As a payment facilitation service on behalf of the Operator, or
    • b.As an advance or partial payment, as applicable
  • c.DriveU may charge a separate convenience or service fee for facilitating bookings.
  • d.DriveU is not responsible for fare disputes between Users and Operators.

6. INVOICING & GST LIABILITY

Pursuant to Section 9(5) of the CGST Act, 2017, DriveU acts as the Electronic Commerce Operator (ECO) for the transportation services provided through its platform. Accordingly:

  • a.DriveU shall issue the Tax Invoice to the User for the gross value of the ride (Passenger Transportation Service).
  • b.DriveU is solely liable for collecting and depositing the applicable Goods and Services Tax (GST) on the transaction to the government.
  • c.The User acknowledges that the Operator (Service Provider) will not issue a separate GST invoice for the ride fare.

7. CANCELLATIONS & REFUNDS

  • a.Cancellation and refund policies are defined by the Operator and disclosed at the time of booking.
  • b.DriveU shall process refunds in accordance with the Operator's policy.
  • c.DriveU is not liable for:
    • a.Operator-imposed cancellation charges
    • b.Delays in Operator refunds

8. USER OBLIGATIONS

Users agree to:

  • a.Provide accurate booking information.
  • b.Comply with Operator instructions during service delivery.
  • c.Not engage in unlawful, abusive, or unsafe conduct.
  • d.Resolve service-related disputes directly with the Operator.

9. SAFETY & COMPLIANCE

  • a.Operators represent and warrant that:
    • a.Vehicles and drivers comply with Applicable Laws
    • b.All permits, insurance, and safety requirements are met
  • b.DriveU does not independently verify or monitor:
    • a.Vehicle condition
    • b.Driver behaviour during trips
  • c.Any incidents or claims shall be addressed between the User and Operator.

10. LIMITATION OF LIABILITY

  • a.DriveU shall not be liable for:
    • a.Acts or omissions of Operators or drivers
    • b.Accidents, injuries, loss, or damage during transportation
    • c.Delays, cancellations, or service deficiencies
  • b.While DriveU handles the invoicing and tax remittance as per statutory requirements, the Operator (Service Provider) remains solely responsible for:
    • a.Service Delivery: The actual provision of transportation services, including safe driving and vehicle condition
    • b.Regulatory Compliance: Ensuring the vehicle possesses valid permits, insurance, fitness certificates, and adhering to all applicable Motor Vehicle laws and regulations.
    • c.Legal Liability: Any liability arising from accidents, misconduct, or violation of transport rules during the trip remains with the Operator.

11. INDEMNITY

Users agree to indemnify DriveU against claims arising from:

  • a.Breach of these Terms
  • b.Misuse of the Platform
  • c.Disputes with Operators

12. INTELLECTUAL PROPERTY

All Platform content, trademarks, and software are owned by DriveU.

No rights are granted except as expressly permitted.

13. PRIVACY

User data shall be collected and processed in accordance with DriveU's Privacy Policy.

14. SUSPENSION & TERMINATION

DriveU may suspend or restrict access to the Platform if:

  • a.These Terms are violated
  • b.Required by law
  • c.Fraud or misuse is suspected

15. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of India.

Courts at Bengaluru, Karnataka shall have exclusive jurisdiction.
